Ghaziabad: It's been four months since Arushi and Hemraj were murdered at the Talwars residence in Noida.The CBI which took over the case and arrested four people in connection with the murder, seem to have made little headway as one of the accused was given bail on Thursday.
First the CBI arrested Arushi's father Dr Rajesh Talwar and then who was later givin bail as no evidence was found against him. Later CBI arrested Dr Talwar's compounder Krishna, Talwars' family friends Durrani's servant Rajkumar and Talwar's neighbour's servant Vijay Mandal.
The CBI court in Ghaziabad on Thursday, granted bail to Vijay Mandal, while the other two were sent back to judicial custody for 14 days more. Crucially, the CBI hasn't yet framed any charges against the three.
Vijay Mandal's younger brother Jairam was ecstatic, as his brother was givem bail.
"Aaj mein maan gaya ki garibon ke saath bhi insaaf hota hai (Today I'm assured that even the poor are given justice)," he said.
First, Rajesh Talwar, Aarushi's father and now Mandal has been let off by the court for the same reason - no evidence.
"Vijay Mandals name was not mentioned in the FIR nor was there any public witness and there is no evidence against him to prove anything. Keeping this in mind, the court let him go," explained defence lawyer Naresh Yadav.
The defence alleged that the CBI was trying to save its face by trying to falsely implicate Krishna, Rajkumar and Mandal.
The CBI argued that the investigations in the case were not yet over and they had scientific evidence to prove Mandals involvement.
"If Mandal is released on bail, he might flee and destroy evidence," said CBI lawyer, R K Saini.
However, the court rejected CBI's argument and granted bail to Mandal with two sureties of Rs 25,000 each.
With the mobile phones and the all important murder weapon still missing, the defence lawyers are optimistic that their remaining two clients will get bail really soon.
According to the law, if an accused has been in custody for 90 days and no charge-sheet has been filed, the accused can apply for statutory bail.
Krishna's 90 day period ends on the September 10, and Rajkumar's on September 27. The defence is hoping that by September end the two would also be given bail.
