New Delhi: The Supreme Court decision to allow Sahara India Commercial Cooperation Ltd (SICCL) to build a boundary wall at Sahara Shahar which was demolished by the Lucknow Development Authority (LDA) last has come as a big relief to the business conglomerate
SICCL had moved SC on Tuesday saying the demolition of the tin fencing at its Shahar project in Gomti Nagar, Lucknow was a violation of a previous stay order for status quo on June 23.
The latest court decision comes on a petition by the Uttar Pradesh government, challenging Allahabad High Court's stay on demolition at the project site.
A vacation bench comprising Justice Altamas Kabir and Justics GS Singhvi appointed senior counsel L Nageshwar Rao as the special officer and the tin fencing would be erected on June 28-29 and Rao would submit his report to the registrar at Lucknow bench of Allahabad High Court.
The apex court had set aside the interim order of Allahabad High Court dated June 19 and asked the High Court to dispose of the writ petition pending in that court with utmost expediency.
The apex court also directed SICCL and LDA not to seek unnecessary adjournments in the High Court.
Earlier, the Judges made it clear, ''We are not satisfied with the explanation offered by the authorities and LDA for removing the tin fencing which is 750 feet long.''
Sahara Shahar is spread over 280 acres of land and the problem started when the LDA demolished the hospital and the boundary wall of the project on June 18 claiming the constructions were illegal and an encroachment on public land.
