Goa: The Investigating Officer in the Scarlette case has been dismissed, however a CNN-IBN Special Investigation has found that the damage has nonetheless been done.

The two of the accused Julio Lobo and Placido Carvalho are also out on bail and the court says that there is no prima facie evidence against them.

Police sources admit that media spotlight on Scarlett's death, kept them from investigating her mother Fiona's background.

The question raised is that with no income, who was paying for Fiona's stay, with her 8 children, in Goa? And why did Fiona regularly visit Gokarna, a beach in Karnataka, infamous for drugs? However, with Fiona back in the UK, she can no longer be questioned.

The police say Carvalho sourced ecstasy from Samson and gave it to Scarlette. However, Scarlette's viscera examination showed no trace of ecstasy. The cops also said that Scarlette took cocaine, but again the viscera examination showed traces of morphine, which points to heroin and not cocaine.

Scarlette was raped, said the police. However, the cops were silent about the vaginal swab report. The presence of sperm in the report would confirm that Scarlette was raped.

The police say a British eyewitness, Michael Manyon, saw Samson sexually assaulting Scarlette, however, postmortem reports only confirm several bruises on the body. There is no mention of serious injury around the vagina, which in would point to sexual assault.

The confessions of the accused are also not admissible in Court, as they weren't recorded before a magistrate. Placido Carvalho now plans to file a defamation case against Fiona, the police and the media.

“The press does not know these things. They don't know what to ask. As long as they sell, even if it's a bunch of lies told by the IGP, it will carry that,” says Defense Lawyer, Jose Peter D'Souza.

Even Fiona's lawyer agrees with the defence. “I think he is right. The cops don't have any case,” says Fiona's Lawyer, Vikram Verma.
