New Delhi: The Delhi High Court on Tuesday ruled that an order asking the Union Public Service Commission (UPSC) to make public marks candidates had got in the preliminary exam of the civil services.

The UPSC had appealed against the Central Information Commission’s (CIC) order. "Disclosure of information, as directed by CIC, cannot harm the interest of UPSC and/or any third party. The approach of CIC in this matter has been in correct persepective," said Justice B D Ahmed said and asked the UPSC to disclose model answer papers to the candidates.

The High Court on April 4 had reserved the order on a petition filed by the UPSC challenging the CIC order directing the Commission to reveal marks of the preliminary exams.

The court had sought explanation from the UPSC on how disclosure of marks of the preliminary exam of civil services exams would adversly affect functioning of the Government body.

The UPSC said if coaching institutes would misuse information if candidates’ marks were to be made public. It said the scaling system used to judge candidates was "very sensitive" and could not be divulged in an open court.

The Commission, however, had agreed to provide information to the students regarding cut-off marks. But the lawyer appearing for the candidates was not satisfied with this and had contended that they should also be provided the marks obtained by them as per the scaling system.
